The provisions of the Tenth Schedule should be amended to provide that:
- All persons defecting must resign from their parliamentary or assembly seats and contest fresh elections.
- Defectors should be debarred from holding any public office (minister or remunerative political post) for at least the remaining term of the legislature or until the next elections.
- A vote cast by a defector to topple a government should be treated as invalid.
- The power to decide disqualification questions on defection should vest in the Election Commission instead of the Speaker/Chairman.
